# A judge blocks Ohio's proof-of-citizenship rule, saying a signed attestation is enough

The law required documents proving citizenship when registering to vote at the motor vehicle bureau. Judge Solomon Oliver Jr found it likely breaches federal law. Ohio's secretary of state will appeal.

A federal judge has temporarily blocked an Ohio requirement that people produce documentary proof of citizenship when registering to vote at motor vehicle bureaus, [Al Jazeera reports](https://www.aljazeera.com/news/2026/8/25/us-judge-blocks-ohio-law-requiring-proof-of-citizenship-to-register-to-vote). Judge Solomon Oliver Jr granted a preliminary injunction on Tuesday.

The requirement was added by the Republican-controlled legislature in 2025, in response to claims, described in the report as unproven, that noncitizens were voting.

## The legal point is narrow and specific

Judge Oliver found the rule likely conflicts with the National Voter Registration Act. He wrote: "Election officials do not need documentary proof of citizenship to assess a voter registration applicant's citizenship because signed attestation of citizenship is enough."

That is a statement about what federal law requires, not about whether documents would be a good idea. Under the NVRA, an applicant signs a statement affirming citizenship under penalty of perjury, and Congress set that as the standard. A state adding a documentary requirement on top is the conflict at issue.

He made a second, more technical finding: the Act requires states to permit registration for federal elections when someone applies for a driver's license, rather than after the Bureau of Motor Vehicles has approved the application.

## The two arguments

The case for such rules is that citizenship should be verified rather than asserted, and that confidence in the roll matters.

The case against is practical. Many eligible citizens do not hold a passport or a birth certificate they can produce at a counter, and the burden falls hardest on people who have moved, changed names, or were born at home. The suit was brought by the voting rights group Red Wine & Blue against the secretary of state, Frank LaRose, on the argument that eligible voters were being disenfranchised.

A preliminary injunction is also not a final ruling. It holds the requirement in abeyance while the case proceeds, on a finding that the challenge is likely to succeed. LaRose says his office disagrees and will appeal.

## What we could not establish

We could not establish how many registrations were affected, whether any evidence of noncitizen voting was presented, which court the appeal goes to, or whether the injunction applies to state as well as federal elections. We verified this account from a single publication, and we have not read the ruling.
